Le graduatorie interne di istituto valide per l’individuazione del docente eventualmente sovrannumerario per l’anno scolastico 2023/24 saranno pubblicate dalle singole istituzioni scolastiche entro il 5 aprile. In esse vale il servizio, le esigenze di famiglia e i titoli culturali. Prevista l’esclusione per i docenti che usufruiscono della legge 104, secondo determinati criteri. I docenti assunti da GPS sostegno e concorso straordinario bis non fanno parte della graduatoria interna di istituto Vi sono due categorie, i docenti assunti nel 2022/23 da GPS sostegno prima fascia ai sensi dell’art. 4 del DL 73/2021 e i docenti assunti da concorso straordinario bis ai sensi dell’art. 9bis del DL 73/2021 che non vengono inseriti nella graduatoria interna di istituto, in quanto assunti con contratto a tempo determinato finalizzato al ruolo. Se il percorso di formazione e valutazione previsto per i due distinti percorsi si concluderà positivamente i docenti saranno assunti a tempo indeterminato dal 1° settembre 2023 sullo stesso posto che nel 2022/23 hanno occupato a tempo determinato. Chiarimenti dall’Ufficio Scolastico di Napoli L’ufficio Scolastico di Napoli ha pubblicato una NOTA di Precisazioni relative alla formazione della graduatoria interna di istituto negli istituti scolastici ove sono presenti docenti individuati ex art. 59 del d.l. n. 73 del 2021 (contratti a tempo determinato finalizzati alle immissioni in ruolo) I punti principali [….] I docenti suindicati non devono essere inseriti nella graduatoria interna di istituto, nella quale devono confluire, esclusivamente, i docenti a tempo indeterminato, titolari presso l’istituto scolastico. In caso di contrazione di organico A titolo esemplificativo si indicano i seguenti casi:a) se presso l’istituto scolastico sono attualmente in servizio 4 docenti di ruolo e 1 un docente ex art. 59 e l’ufficio dovesse autorizzare l’organico tale da sviluppare complessivamente 4 cattedre per quella classe di concorso, in tal caso non vi è alcun soprannumerario. Per il docente assunto in base alla procedura ex art. 59, la nuova sede sarà individuata dopo le operazioni di mobilità. b) Qualora, invece, l’Ufficio dovesse autorizzare 3 cattedre, vi saranno un docente (di ruolo) soprannumerario, nonché un docente, assunto ex art. 59, la cui sede sarà individuata con la procedura sopra descritta.
